| Mother Sentenced to Serve 4 to 15 Years in Prison for Her Role in 3-Year-Olds Death 05/05/17 11:00am |
State Prison, for her role in the July death of her three-year-old daughter, during proceedings this morning in Lewis County court. Shelby L. Poore-Mcintosh, 23, pleaded guilty to second-degree Manslaughter, a class "C" felony, on October 20 in Lewis County Court, satisfying all charges against her in the original indictment. Judge Daniel R. King said after reviewing pre sentence documents he had decided to impose a lengthier sentence than the original argreement at the time of plea. Ms. Poore-McIntosh was given an opportunity to withdraw her plea at that time, which she declined. "It's usually not easy for me to sentence people to prison terms," Judge King said, "but in this case I have no problem at all. I wish you no luck. A parent is supposed to do everything in their power to protect their children and you failed in that task. You have no remorse and I don't think you are capable of remorse." "In some ways her moral actions are worse than the criminal actions of Derrick McDermid, but we can't sentence on moral actions," Lewis County District Attorney Leanne Moser said. Ms. Poore-McIntosh told the court that this has been "very hard" on her and she is very sorry for what happened. She was charged in September in connection to the July 12 death of her three- year-old daughter, Kyralea Poore-McIntosh. At that time, her boyfriend, Derrick McDermid, was charged with counts of second-degree Murder, first-degree Manslaughter, first-degree Assault, Endangering the Welfare of a Child, and two counts of second-degree Assault. On January 17, Mr. McDermid, in exchange for dropping the top count of second-degree murder, entered guilty pleas to each of the other counts. He was sentenced on April 4 to serve 37 1/2 years in State Prison, followed by a 10-year parole term. |
