NOTICE OF PUBLIC HEARING REGARDING THE ESTABLISHMENT OF A
NEW WATER DISTRICT IN THE TOWN OF LOWVILLE TO BE KNOWN AS
WATER DISTRICT #10 AND THE ACQUISITION, CONSTRUCTION AND
INSTALLATION OF WATER SYSTEM IMPROVEMENTS.
PLEASE TAKE NOTICE that the Town Board of the Town of Lowville will
conduct a public hearing on the 8th day of September, 2025 at 9:35
A.M at the Town Hall, 5533 Bostwick Street, Lowville, New York 13367
regarding the proposed creation of new Water District #10 in accordance
with the following resolution and order of the Town Board adopted on the 21st
day of August, 2025 at a regular meeting thereof:
RESOLUTION SCHEDULING A PUBLIC HEARING REGARDING
THE ESTABLISHMENT OF A NEW WATER DISTRICT IN THE
TOWN OF LOWVILLE TO BE KNOWN AS WATER DISTRICT #10
AND THE ACQUISITION AND INSTALLATION OF WATER SYSTEM
IMPROVEMENTS.
WHEREAS, the Town Board of the
Town of Lowville (“the Town”) caused a map, plan and report to be
prepared by Bernier, Carr and Associates, licensed engineers, in
connection with the proposed establishment of a new Water District #10;
and
WHEREAS, such maps and plans have
been duly filed in the Office of the Town Clerk of the Town of Lowville and they are available for public, review,
inspection and copying at the Clerk’s Office at 5533 Bostwick Street,
Lowville, New York during normal business hours; and
WHEREAS, the general area to be
served by the proposed new district is in the vicinity of Markowski Road
and part of Number Four Road within the Town; and
WHEREAS, the boundaries of the
proposed new district are more exactly set out in the attached surveyor’s
description; and
WHEREAS, the
proposed project includes installation of water mains, service laterals,
fire hydrants, valves, corporation stops, curb stop assemblies and other
equipment and components necessary to establish a reliable functioning
water system; and
WHEREAS, it is estimated the new
district would service approximately 26.5 Equivalent Dwelling Units; and
WHEREAS, the total project cost
is estimated at $3,945,00.00; and
WHEREAS, it is anticipated there
will be no hookup fees charged to users by the District
for connections; and
WHEREAS, the estimated annual
first year cost per typical user is $1057.00 or less which is less than
the average charge of $1,101.00 established by the New York State
Comptroller pursuant to Town Law Section 209-f; and
WHEREAS, the proposed method of financing consists of the issuance of bond
anticipation notes and serial bonds of the Town to mature in annual
installments over an estimated term of thirty years, payable in the first
instance from assessments levied on benefited real properties in the
proposed district; in addition to which the Town will seek WIIIA and EPA
grant funding as well as a 0% 30 year NYSEFC DWSRF loan; and
WHEREAS, the cost of the project
and related debt service will be assessed by the Town in proportion as
nearly as may be to the benefit which each lot or parcel in the district
will derive therefrom.
NOW THEREFORE, BE IT RESOLVED AND
ORDERED that the Town
Board will hold a public hearing to hear all persons
interested in the establishment of proposed Water District #10 which
public hearing shall be held on the 8th day of September 2025
at 9:35 AM at the Town Hall, 5533 Bostwick Street, Lowville, New York;
and be it further
RESOLVED AND ORDERED that the Town Clerk shall give notice of such hearing by
publishing a copy of this resolution in the official town newspaper or
other newspaper of general circulation in the Town, and by posting a
certified copy on the Clerk’s sign board not more than twenty nor less than ten days before such hearing.
The above resolution was duly moved by Councilman Monnat and
seconded by Councilman Farney at a regular meeting of the Town Board held
on the 21st day of August, 2025 at
the Town Hall. After due
deliberation, the question of the foregoing resolution was duly put to a
vote on roll call, which resulted as follows:

EXISTING WATER DISTRICT #9 IN THE TOWN OF LOWVILLE AND
TRANSFERRING THEM TO A PROPOSED NEW WATER DISTRICT #10.
PLEASE TAKE NOTICE that the Town Board of the Town of Lowville will conduct a public hearing on the 8th
day of September 2025 at 9:35 AM at the Town Hall, 5533 Bostwick Street,
Lowville, New York 13367regarding a proposal to remove five parcels of
land from existing Water District #9 and to transfer the same parcels to
the presently proposed Water District 10 in accordance with the following
resolution and order of the Town Board adopted on the 21st day of August,
2025 at a regular meeting thereof.
RESOLUTION
SCHEDULING A PUBLIC HEARING REGARDING
THE REMOVAL OF FIVE
PARCELS OF LAND FROM EXISTING WATER
DISTRICT #9 TO
FACILITATE THE DEVELOPMENT OF PROPOSED
WATER DISTRICT #10.
WHEREAS, the Town Board of the Town of Lowville is contemplating a proposed new Water District #10 and retained the
services of Bernier, Carr, and Associates to develop a map, plan and
report in connection therewith; and such map, plan and report have been
filed with the Lowville Town Clerk; and
WHEREAS, during the course of developing the map, plan and report it
appeared that creation and development of the new district could be
facilitated by the removal of five parcels of land from existing Water
District 9, none of which are currently receiving water service but are
capable by adjacency and proximity
of being placed in the proposed new district, thereby becoming able to
secure water service; and
WHEREAS, in consequence of the aforementioned
conclusion the Town Board directed Bernier Carr and Associates to
develop a Map, Plan and report to remove and transfer the aforementioned five parcels; such Map, Plan and Report
have been completed and filed in the Town Clerk’s Office where they are
available for review, inspection and copying during regular business
hours; and
WHEREAS, the boundaries of existing Water District #9 and the boundaries of
the five parcels to be removed and transferred are set forth in two
attachments hereto, the first being the “Original District #9” and the
second being described as “Parcel Removal”; and
WHEREAS, it appears to the Town Board that such a removal and transfer
would cause no financial harm to Water District #9 as the involved
parcels receive no services and contribute no revenue; and
WHEREAS, this removal and transfer proposal has already been taken into account with regard to
SEQRA review of the new Water District #10 proposal as well as the
development of its Map, Plan and Report so would pose no adverse
environmental or financial issues for the new district.
NOW THEREFORE, BE IT RESOLVED AND ORDERED
that the Town Board will hold a public hearing to hear all persons
interested in the proposed removal and transfer of the aforementioned
five parcels, which public hearing will be held on the 8th day
of September, 2025 at 9:35 AM at the Town Hall, 5533 Bostwick Street,
Lowville, New York ; and be it further
