Region 6 SPDES Renewals Multiple Counties Applicant: Ownenergy Inc 45 Main St Ste 536 Brooklyn, NY 11201 Facility: Copenhagen Wind Farm Approximately 9200 Acre Leased Area With 40 Turbines in the Town of Denmark and 8.9 Mile Collection Line Thru Towns of Rutland and Champion Copenhagen, Rutland, Champion, NY Application ID: 6-9906-00074/00001 Permit(s) Applied for: Article 24 Freshwater Wetlands Article 11 Endangered/Threatened Species (Incidental Take) Section 401 - Clean Water Act Water Quality Certification Project is Located: Denmark, Multiple Counties Project Description: Copenhagen Wind Farm LLC (the Applicant) is proposing to develop a wind- powered generating facility in the Town of Denmark, Lewis County and the Towns of Rutland and Champion, Jefferson County, NY. The Project involves 40 2.0 megawatt (MW) wind turbines that will deliver up to 79.9 MW of electrical power to the NYS power grid. In addition to the wind turbines solely in the Town of Denmark, the project involves construction of associated components, including one or two permanent meteorological towers, 13.3 miles of gravel access roads, 19.1 miles of 34.5 kilovolt (kV) electrical collection lines, an operation and maintenance building and a collection substation. The Applicant also proposes to construct a 115 kV transmission line in the Towns of Rutland and Champion and a point of interconnection substation in the Town of Rutland. The transmission line will be approximately 8.9 miles in length. The proposed project is located on approximately 9200 acres of leased land or land that is currently under negotiation for lease. The project is anticipated to start shortly after October 1 of 2016 and be completed by December 31 of 2017. An Article 24 Freshwater Impact Permit is requested for permanent wetland impacts to include 12.5 square feet of impact to the 100 foot adjacent area of RU- 19 and 25 square feet of impact to the 100 foot adjacent area of RU-25. These impacts are due to three transmission line poles. An Incidental Take Permit of Endangered/Threatened Species is requested for potential impacts to the Indiana bat and northern long-eared bat. A 401 Water Quality Certificate is requested due to impacts on Army Corps of Engineers regulated wetlands via federal law. Availability of Application Documents: Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person. State Environmental Quality Review (SEQR) Determination: A draft environmental impact statement has been prepared on this project and is on file. SEQR Lead Agency: Denmark Town Planning Board State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required. Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act. DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29) It has been determined that the proposed action is not subject to CP-29.
