Lewis County Court Activity Report for June 17, 2021

Lowville, NY- The following
plea and sentencing activity took place in Lewis County Court on Thursday
morning, with the Honorable Daniel R. King presiding:
Alexander Jordan, 25, of Croghan,
was sentenced to serve 16 years in State prison, followed by 10 years of
post-release parole supervision, on a charge of first-degree Course of
Sexual Conduct Against a Child, a class B felony. Mr. Jordan entered a
guilty plea to the charge on April 30, admitting to having sexual contact
with a child under the age of 13 on multiple occasions between November 1, 2017 and December 6, 2019 in the town of Croghan. He was
additionally ordered to pay $1,425 in fines and court fees. An order of
protection was issued on behalf of the victim.
James J. Lynch, 32, of Lyons
Falls, was scheduled to be sentenced on a charge of fifth-degree Criminal
Sale of a Controlled Substance, a class D felony, to which he pleaded guilty to on February 26. Mr. Lynch did
not show up to court for his scheduled sentencing Thursday morning,
resulting in a bench warrant for his arrest being issued by Judge King.
Under the plea agreement, Mr. Lynch was originally supposed to receive a
6-month term at the Lewis County Jail. He is now in violation of the
enhanced sentencing agreement he signed at the time of the plea, since he
has also picked up additional charges since his plea,
and now could be facing up to 2 ½ years in State prison, on the charge he has
pleaded guilty to, as a result.
Cody D. Marolf, 27, of Turin, was allowed to vacate a
plea to felony Driving While Intoxicated charge, following successful
completion of interim probation, and instead pleaded guilty to a
misdemeanor Driving While Intoxicated charge. He was then placed on
probation for 3 years, with a credit for the year of interim probation.
Additionally, he was ordered to pay $375 in court fees and a $1,000 fine,
will have his driver’s license revoked for 1 year and must participate in a
victim impact panel. At the time of the original plea on January 25, 2020, he
admitted to driving after consuming alcohol on September 22, 2019, in the village
of Lowville. Mr. Marolf was previously convicted on
a DWI charge in the town of Denmark on July 25, 2018.
Larry M. Mutchler, 41, of Lowville,
was sentenced to a 5-year term of probation supervision after successful
completion of interim probation on a charge of fifth-degree
Attempted Criminal Possession of a Controlled Substance, a class E felony.
Mr. Mutchler pleaded guilty to the charge on April 26, 2019, admitting to
attempting to possess methamphetamine, with the intent to sell, in the
village of Lowville on February 4, 2019. He was additionally ordered to pay
$375 in court fees.
Richard M. Nellenbach, Jr., 32, of Lowville, was sentenced as
a second-felony offender to serve 2 to 4 years in State prison on three
counts of third-degree Burglary, class D felonies. He pleaded guilty to the
charges on April 30, Lowville, admitting to entering multiple businesses in the
village of Lowville in March of 2020, with the intent to commit a crime. He
was additionally ordered to pay $750 in court fees and $1,650 in
restitution.
Kayla M. Noftsier, 26, of Lowville, was sentenced to serve
a 5-year term of probation supervision on a charge of fifth-degree
Attempted Criminal Possession of a Controlled Substance, a class E felony,
to which she pleaded guilty to on September 04, 2020 when admitting to
attempting to possess methamphetamine with the intent to sell on April 30,
2020, in the village of Lowville. She was additionally ordered to pay $375
in court fees.
Jeremy F. Snyder, 36, of
Copenhagen, pleaded guilty to one count each of fourth-degree Criminal
Possession of Stolen Property, a class E felony, and Endangering the
Welfare of a Child, a class A misdemeanor. He admitted to possessing over $1,000
worth of stolen property on September 5, 2019, in the town of Croghan, and
acting in a manner injurious to a child on September 1, 2019, in the town
of Croghan. Sentencing was adjourned to August 27, when Mr. Snyder is
expected to be sent to State prison for 2 to 4 years as a second-felony
offender.
Ryan L. Watson, 21, of Marcy,
was sentenced to serve one year in the Lewis County Jail, to run
concurrently with a State prison sentence he is
already serving, on a count of second-degree Sexual Abuse, a class A
misdemeanor, to which he pleaded guilty to on April 16, when admitting to having
sexual contact with a child in the town of Leyden in January 2017. He was
additionally ordered to pay $250 in court fees and an order of protection
was issued on behalf of the victim.
The next session
of Lewis County Court is scheduled for July 2, 2021.
