Lewis County Court Activity Report for April 16, 2021

The following
plea and sentencing activity took place on Friday morning in Lewis County
Court, with the Honorable Daniel R. King presiding:
Mary L. Barker, 64, of
Copenhagen, pleaded guilty to one count of first-degree Attempted
Possession of a Forged Instrument, a class C felony, admitting to
attempting to pass a
counterfeit $100 bill when trying to purchase items at the Stewart’s Shop
in Copenhagen on June 23, 2020. Sentencing in the case was
adjourned to May 25, when Ms. Barker is expected to be placed on interim
conditions of probation.
Mitchell O. Fruin, 22, of Lyons Falls, pleaded guilty to
one count each of Aggravated Vehicular Assault, a class C felony, and
Driving While Ability Impaired by Drugs, a class E felony. Mr. Fruin admitted that on October 6, 2020, in the town of Lyonsdale, he engaged in reckless driving, while under
the influence of methamphetamine, resulting in a crash that
caused serious injuries to a 15-year-old passenger in the vehicle. Sentencing in
the case is scheduled for May 7, when Mr. Fruin
is expected to receive 1 1/3 years in State prison.
Christopher M.
Hemberger, 34, of Clay, NY, was sentenced to serve a 3-year term of probation
on charges of second-degree Criminal Contempt and fourth-degree Criminal Possession
of a Weapon, both class A misdemeanors, to which he pleaded guilty to on
January 8. He was additionally ordered to pay $250 in court fees in both
cases.
Brandon E. Hoffert, 36, of Port Leyden, was sentenced to
serve a 3-year term of probation on a charge of second-degree Falsifying
Business Records, a class B misdemeanor, to which he pleaded guilty to on
February 5. He was additionally ordered to pay $250 in court fees.
Justin J. Waldron, 32, of
Lowville, pleaded guilty to one count each of third-degree Criminal
Possession of a Controlled Substance, a class B felony, and Criminal Use of
Drug Paraphernalia, a class A misdemeanor, admitting to possessing 5.7
grams of methamphetamine and scales used for packaging the substance during
a traffic stop in
the town of Martinsburg on October 12, 2020. Sentencing in
the case is scheduled for May 25, when Mr. Waldron is expected to receive 2
years in State prison with the potential for a mandate to the prison system’s
Willard Drug Rehabilitation Program.
Ryan L. Watson, 21, of Marcy,
NY, pleaded guilty to one count of second-degree Sex Abuse, a class A
misdemeanor, stemming from an arrest in
February. Sentencing in the case was adjourned to June 17.
Sierra B. Wetmore, 29, of Port
Leyden, was placed on interim conditions of probation on a charge of third-
degree Burglary,
a class D felony, to which she pleaded guilty to on March 5 when admitting
to illegally entering a Lowville business in March of 2020 with the intent
to steal money. Final sentencing in the case is adjourned until the
completion of the interim probation term.
