Lewis County Court Activity Report for August 14, 2020

    Lowville, NY- The following plea and sentencing activity took place on Friday in
    Lewis County Court with the Honorable Daniel R. King presiding:

    William LaPorta, Jr., 36, of Melrose, NY, was sentenced to serve 4 years in
    State prison followed by 2 years of post-release parole on a charge of third-
    degree Criminal Sale of a Controlled Substance, a class B felony. Mr. LaPorta
    entered a guilty plea to the charge on December 13, admitting to selling LSD on
    July 6, 2019 in the town of Turin at the moe.down music festival, satisfying all ten
    charges handed up by a grand jury. Judge King then mandated Mr. LaPorta to
    the State prison system's Willard Drug Rehabilitation program, which allows
    inmates to serve the remainder of their prison sentence on parole after
    successful completion of the 90 day program. Mr. LaPorta was ordered to pay
    $350 in fines and will have his driver's license suspended for six months. He will
    also forfeit over $4,000 in seized assets and buy money.

    Abigail J. Loomis, 36, of Ava, was sentenced to 3 years of probation and 40
    hours of community service after successful completion of interim probation. Ms.
    Loomis was placed on interim probation for a year on July 19, 2019 after
    previously pleading guilty to one count of fourth-degree Criminal Possession of a
    Controlled Substance, a class C felony, admitting to possessing hydromorphone
    in the town of West Turin in July of 2018. With the successful completion of
    interim probation, Ms. Loomis was allowed to vacate her plea to the felony
    charge on Friday and instead pleaded guilty to seventh-degree Criminal
    Possession of a Controlled Substance, a class A misdemeanor. She was
    additionally ordered to pay $250 in court fees.

    Daniel J. Mace, 30, of Kirkland, NY, pleaded guilty to a charge of fourth-degree
    Grand Larceny, a class E felony. Mr. Mace admitted to cashing over $55,000
    worth of checks as a contractor in 2018, from a victim in the town of Osceola,
    while never performing the work he was paid to do. Restitution in the amount of
    $55,000 was paid at the time of the plea, with sentencing in the case adjourned
    to October 16. Mr. Mace is expected to receive a 3 year conditional discharge at
    that time. He is also facing similar charges in Oneida County.

    Andrew F. Muncy, 30, of Lowville, pleaded guilty to one count each of Driving
    While Intoxicated, an unclassified misdemeanor and third-degree Aggravated
    Unlicensed Operation of a Vehicle, an unclassified misdemeanor. Mr. Muncy
    admitted to operating a vehicle in the town of Martinsburg on August 24, 2019,
    while under the influence of alcohol and knowing his license to drive was
    suspended for nine traffic violations on nine different dates. Sentencing in the
    case was adjourned to October 9, when Mr. Muncy is expected to be placed on
    probation for 3 years.

    Renee J. Ross, 36, of New Bremen, was sentenced to serve 5 years on
    probation after successfully completing the Lewis County Drug Court program.
    Ms. Ross was placed in the program on May 17, 2019 after entering guilty pleas
    to one count each of second-degree Criminal Possession of a Controlled
    Substance (CPCS), a class A-2 felony, and Endangering the Welfare of a Child,
    a class A misdemeanor. During the plea, Ms. Ross admitted that on March 8,
    2019, she was in possession of over 109 grams of methamphetamine during an
    early morning raid of her Artz Road residence by the Lewis County Drug Task
    Force, after a 3 month investigation. On Friday, Ms. Ross was able to vacate her
    plea to the second-degree Criminal Possession of a Controlled Substance
    charge and instead plead guilty to third-degree Criminal Possession of a
    Controlled Substance, a class B felony, after successfully completing drug court.
    She was additionally ordered to pay $375 in court fees.

    Ashley M. Walseman, 30, of Croghan, was sentenced to serve 5 years on
    probation after successfully completing the Lewis County Drug Court program.
    Ms. Walseman was placed in the program on January 11, 2019, after entering
    guilty pleas to one count each of third-degree Attempted Burglary, a class E
    felony and third-degree Unlawful Manufacture of Methamphetamine, a class D
    felony, admitting to breaking into the Watson Inn during the overnight hours of
    January 16-17, 2018 to steal money and possessing materials to manufacture
    methamphetamine during a July 26, 2018 traffic stop in the town of Lowville. On
    Friday, Ms. Walseman was allowed to vacate her plea to the felony Attempted
    Burglary charge and instead plead guilty to Petit Larceny, a class A
    misdemeanor. The plea to Unlawful Manufacture of Methamphetamine remains
    unchanged. She was additionally ordered to pay $847 in restitution and a total of
    $625 in court fees.

    In addition, the following sentencing activity took place in Lewis County
    Court on August 7, 2020, with the Honorable Daniel R. King presiding:

    Venus S. Edmister, 44, of Ontario County, NY, was sentenced as a second-
    felony offender to serve 1 1/2 to 3 years in State prison on a charge of fourth-
    degree Grand Larceny, a class E felony, which she pleaded guilty to on January
    20, when admitting to stealing a ring valued at over $1,000 in the town of
    Montague between the dates of October 16 and November 4, 2019. She was
    additionally ordered to pay $375 in court fees.

    Xavier T. Polk, 33, of Boonville, was sentenced to serve 1 year in Lewis County
    Jail on a charge of seventh-degree Criminal Possession of a Controlled
    Substance, a class A misdemeanor. Mr. Polk pleaded guilty to the charge on
    December 13, 2019, admitting to possessing the drug ecstasy as a passenger
    involved in a motor vehicle accident on August 25, 2019 in the town of Turin. Mr.
    Polk was additionally fined $500 and was ordered to pay $250 in court fees.
