Port Leyden Man Pleads Guilty to
Three Felony Counts in Lewis County Court

    Lowville, NY- The following activity took place this morning in Lewis County
    court, with the Honorable Daniel R. King presiding:

    Cody J. Fox, 28, of Port Leyden, appeared in court and accepted a plea deal,
    pleading guilty to the following counts:

  • Second-degree Criminal Possession of a Weapon, a class C Felony;
  • Second-degree Unlawful Manufacture of Methamphetamine, a class C
    Felony;
  • Second-degree Assault, a class D felony

    The plea satisfies all charges Mr. Fox was facing.

    Sentencing in the case was scheduled for April 26, when Mr. Fox is expected to
    receive a sentence of 14 years in State prison followed by 8 years of post-
    release parole.

    Mr. Fox admitted to possessing a loaded 9mm handgun on January 9, 2018, in
    the Town of Martinsburg. In addition, he admitted to possessing materials used
    in the manufacturing of methamphetamine on February 24 in the Town of
    Lowville and assaulting an individual in the Town of Watson on the same date.

    Mr. Fox was previously convicted of third-degree Unlawful Manufacture of
    Methamphetamine in Lewis County court in June of 2016, resulting in a harsher
    penalty for the current charge.


















    In other court activity:

    Joshua L. Mellnitz, 25, of Glenfield, was sentenced to 5 years of probation on a
    charge of Aggravated Driving While Intoxicated, a class E felony, to which he
    pleaded guilty to on December 21. In addition to a one-year diver's license
    revocation, Mr. Mellnitz was ordered to:
  • Perform 100 hours of community service
  • Pay $1,237.06 in restitution
  • Pay a $1,500 fine
  • Pay $570 in court fees
  • Participate in a Victim Impact Panel
  • Install an Ignition Interlock Device

    Mr Mellnitz was charged with Aggravated DWI after registering a .27 B.A.C. while
    driving on the Wetmore road in the town of Watson on June 10, 2018. He was
    previously convicted of DWI in 2014, automatically making the current charge a
    felony.

    Anthony Pickel, 37, of Lowville was arraigned on a charge of second-degree
    Unlawful Manufacture of Methamphetamine, a class "C" felony, after an
    indictment was handed up by a Lewis County grand jury. He pleaded not guilty to
    the charge during arraignment.

    The charge stems from an alleged meth lab discovered behind Mr. Pickel's home
    in October during a visit from parole officers. He was on parole for a previous
    meth conviction from January of 2018 in Lewis County court
                 Cody Fox
