Lowville- The following activity took place in Lewis County Criminal Court on
    Friday, December 16, 2016, with Judge Daniel R. King presiding:

    Sentencing:

    Amir Budnjo, 35, of Utica, was sentenced to a term of 1 1/3 to 4 years in State
    prison, to be served concurrently with a sentence from Oneida County, on an
    Aggravated Driving While Intoxicated charge, a class "D" felony. He was
    additionally sentenced to five-years of post-release parole, ordered to pay
    $570 in court fees and a $1,500 fine, and received an eighteen-month
    revocation of his drivers license. Mr. Budnjo was arrested August 1st on the
    Blanchard Truck Trail in the Town of Croghan with a reported blood alcohol
    content of .20%.

    Lucas W. Dafoe, 26, Port Leyden, received sentencing on a charge of felony
    Driving While Intoxicated, after unsuccessful completion of the county's Drug
    Court program. Mr. Dafoe entered a guilty plea to the charge on March 18th, at
    which time he entered the Drug Court program. On Friday, Judge King
    sentenced Mr. Dafoe to serve one-year in the Lewis County Jail and a three-
    year conditional discharge on a probation violation. He was ordered to pay a
    $2,000 fine and $570 in court fees, as well as having his license revoked for a
    one-year period. Mr. Dafoe was arrested on November 3, 2015, on Boonville
    Road in the town of Lyonsdale.

    Richard M. Nellenbach, 28, Lowville, received an indeterminate sentence of 3
    1/2 - 7 years in State prison, to run concurrent to sentencing received in
    Oneida County, on a charge of third-degree Burglary, a class "D" felony, as a
    second-felony offender. He entered a guilty plea to the charge on October
    28th. He was ordered to pay $375 in court fees and $165 in restitution. The
    charge stemmed from an incident on April 3rd in the Town of Harrisburg.

    Kaitlin N. Potter, 25, Lowviile, was sentenced to a three-year probation term
    and 50-hours of community service, on a charge of Petit Larceny, a class "A"
    misdemeanor. She was ordered to pay $2,150 in restitution, $250 in court fees
    and must stay out of all Walmart stores for three years. Ms. Potter Ms. Potter
    was accused of taking $2,150 between February 3rd and 18th,while employed
    as a cashier at the Lowville Walmart.


    Tonia A. Simmons, 38, Castorland, was sentenced as a second-felony
    offender on a charge of third-degree Criminal Sale of a Controlled Substance,
    a class "B" felony, to which she entered a guilty plea on November 4th,
    satisfying all four counts she was originally charged with. She was ordered to
    serve three-years in State prison followed by three-years of post-release
    parole. She was mandated for the state prison system’s 90-day Willard Drug
    Rehabilitation Program, which allows inmates who successfully complete the
    program to serve the remainder of their prison sentences under parole
    supervision, was ordered to pay $80 in restitution and $50 in court fees and will
    receive a six-month drivers license suspension. Ms. Simmons was accused of
    selling a controlled substance on May 26th in the Town of New Bremen and
    was arrested on September 28th as part of the "Operation Northern Watch"
    drug roundup.

    PLEAS:

    Cody W. Compeau, 29, of Phoenix, NY, entered a GUILTY plea to a charge
    of felony Driving While Intoxicated, a class "E" felony due to a previous
    conviction in Oswego County in 2012. Sentencing was scheduled for February
    17th. Mr. Compeau was arrested on October 9th after a traffic stop on Dayan
    Street in the Village of Lowville.
