today, with Judge Daniel R. King presiding: Sentencing: Wesley A. Cole, 28, of Castorland, was sentenced to serve ten years on probation on a charge of first-degree Sexual Abuse, a class "D" felony, to which he pleaded guilty to on September 23rd. He was additionally ordered to pay a total of $1,425 in court fees and will be required to register as a Level 1 Sex Offender. A no contact order of protection was issued on behalf of the victim for a period of ten years. Mr. Cole was accused of having inappropriate contact with a male victim under the age of eleven in September of 2014. Andrew M. Ellis, 30, Lowville, was sentenced to serve a three-year probation term and ordered to perform 100 hours of community service on a charge of second-degree Criminal Trespass, a class "A" misdemeanor, to which he pleaded guilty to on September 23rd. He was additionally ordered to pay $275 in restitution and $50 in court fees. Mr. Ellis was accused of possessing a 2015 Novai dump trailer belonging to another party on September 17, 2015, in the town of West Turin. Daryan J. Nichols, 18, Lowville, was sentenced to one-year in Lewis County Jail, on a charge of third-degree Unlawful Manufacture of Methamphetamine, a class "D" felony, and six-months in Lewis County Jail , to run consecutively, on a charge of first-degree Reckless Endangerment, a class "D" felony. He was additionally ordered to pay $29,589.45 in restitution, joint and several with the co-defendants, an individual restitution of $79.50 and $375 in court related fees, and will receive a six-month suspension of his driver's license. Judge King granted him youthful offender status, meaning the charges will be vacated from his record. He pleaded guilty to the charges on September 23rd. The charges stem from his involvement in the May 18th fire that destroyed an apartment house in downtown Lowville. Charles E. Orr, 54, Lowville, was sentenced on three separate counts of third- degree Criminal Sex Act, class "E" felonies. He received consecutive sentences of four years in State prison, three years in State prison and three years in State prison, as well as five years of post release parole. He was ordered to pay $4,275 in court fees and surcharges, and an order of protection was issued on the victim's behalf for an eight-year period. A hearing will be held to decide which level of sex offender he will be required to register as. Renea L. Farr, 30, Port Leyden, Received a one-year Conditional Discharge on a charge of fourth-degree Criminal Mischief, a class "A" misdemeanor, to which she pleaded guilty to on October 28th. Restitution in the amount of $500 had been paid and the court fees were waived. Ms. Farr was arrested in July after allegedly causing damage to a vehicle owned by another party. Heather K. Gorczyca, 43, Lyons Falls, was sentenced by conflict Judge John J. Brennan, Herkimer County Court, to serve a five-year term of probation, pay $200 in restitution and a $50 court fee on a charge of second-degree Forgery, a class "D" felony. She was accused of forging a signature on a check in the Town of West Turin on October 31, 2015. PLEAS: Sasha E. Eckelman, 28, of Glenfield, accepted an offer and entered a GUILTY plea to a charge of fifth-degree Criminal Sale of a Controlled Substance, a class "D" felony, satisfying the original charges of third-degree Criminal Possession of a Controlled Substance and third-degree Criminal Sale of a Controlled Substance, both class "B" felonies. Sentencing was scheduled for December 2nd. Ms. Eckelman was accused of possessing and selling heroin in the Town of Watson in April, and was one of the sixteen people arrested during Operation Northern Watch in September. David A. Gerdon II, 39, Lowville, pleaded GUILTY to charges of Operating a Motor Vehicle While Impaired by Drugs, a class "E" felony and Aggravated Unlicensed Operation of a Motor Vehicle, an unclassified misdemeanor. He was then entered into the Lewis County Drug Court Program, with sentencing set after successful completion. Mr. Gerdon was arrested following an afternoon accident on July 29th on the Erie Canal Road in the Town of New Bremen. He was previously convicted on a DWI-Drugs charge, in the Town of Denmark, in January of 2013, resulting in the felony charge. Tonia A. Simmons, 38, Castorland, accepted an offer and pleaded GUILTY to a charge of third-degree Criminal Sale of a Controlled Substance, a class "B" felony, satisfying all four counts she was originally charged with. Her case was adjourned until December 16th. Ms. Simmons was accused of selling a controlled substance on May 26th in the Town of New Bremen and was arrested on September 28th as part of the "Operation Northern Watch" drug roundup. |
