Friday, September 23, with Judge Daniel R. King presiding: Sentencing: Michael L. Ball, 27, of Beaver Falls, was sentenced to a One-Year Conditional Discharge on a charge of second-degree Criminal Trespass, a class "A" misdemeanor and a concurrent sentence of a One-Year Conditional Discharge on a charge of third-degree Criminal Trespass, a class "B" misdemeanor. He was additionally ordered to pay $50 in court related fees. Mr. Ball was accused of unlawfully entering or remaining in a dwelling on George Hill Road in the Town of Watson on May 17, 2015 and entering a building on Main Street in the Town of Croghan on May 8, 2016. He was additionally ordered to pay $1,445 in fines and court fees, attend a Victim Impact Panel, install an ignition interlock device on any vehicle he will drive, as well as receiving a one year revocation of his driver's license. Mr. Bole was arrested by Lowville Police just after midnight on April 17th, on Turin Road in the village, where he was accused of Driving While Intoxicated and possessing a knife with metal knuckles, and pleaded guilty to the charges on July 15th. Jesse J. Farney, 30, of Glenfiled, received a sentence of five years of probation on a charge of third-degree Unlawful Manufacture of Methamphetamine, a class "D" felony, to which he pleaded guilty on July 29th. He was additionally ordered to pay $375 in court fees and had a six-month suspension placed on his driver's license. Mr. Farney was accused of making methamphetamine on December 28, 2015 in the Village of Port Leyden. Katie L. Farney, 36, of Glenfield, received a sentence of six months in Lewis County Jail and five years of probation on a charge of third-degree Unlawful Manufacture of Methamphetamine, a class "D" felony, to which she pleaded guilty on July 29th. She was additionally ordered to pay $375 in court fees and had a six-month suspension placed on her driver's license. Ms. Farney was accused of making methamphetamine on December 28, 2015 in the Village of Port Leyden. Judith Grasso, 53, of Shokan, NY, was sentenced to five years of probation on a charge of fifth-degree Attempted Criminal Sale of a Controlled Substance, a class "E" felony, to which she pleaded guilty on July 15th. She was additionally ordered to pay $50 in court related fees and paid $155 in restitution. Ms.Grasso was accused of selling LSD during the moe.down music festival in August, 2014. Donald E. Jones, 51, of Lyons Falls, was sentenced to three years of probation on a charge of fourth-degree Attempted Criminal Tax Fraud, a class "A" misdemeanor, to which he pleaded guilty to on July 29th. He was also ordered to pay $3,971.55 in restitution and $200 in court fees. Mr. Jones was accused of possessing 83 cartons of untaxed cigarettes, valued at over $3600, on April 13th in the Town of Greig. Justin E. Pate, 32, Lowville, was sentenced to six months in Lewis County Jail and three years of probation (to run concurrently) on a charge of Petit Larceny, a class "A" misdemeanor. He was ordered to pay $440 in restitution and $250 in court fees. Mr. Pate was accused of stealing a Remington rifle belonging to someone else on November 22, 2015 in the Town of New Bremen. Christopher J. Smith, 30, of Vernon, was re-sentenced after successfully completing his one-year interim terms of probation. His original plea to felony Driving While Intoxicated was vacated and he received a three-year probation sentence on a misdemeanor Driving While Intoxicated plea. He was ordered to pay a $500 fine and $395 in court fees, received a driver's license revocation for a period of six months and must install an ignition interlock device on any vehicle he drives. Mr. Smith was stopped on an ATV in the Town of Pinckney on April 18, 2015. Bram L. Widrick, 18, of Lowville, was sentenced to one-year in Lewis County Jail, on a charge of third-degree Unlawful Manufacture of Methamphetamine, a class "D" felony, and six-months in Lewis County Jail (to run concurrently) on a charge of first-degree Reckless Endangerment, a class "D" felony. He was additionally ordered to pay $29,502 in restitution and $50 in court related fees, and will receive a six-month suspension of his driver's license. Judge King granted him youthful offender status, meaning the charges will be vacated from his record upon completion of his jail term. The charges stem from his alleged involvement in the May 18th fire that destroyed an apartment house in downtown Lowville. PLEAS: Wesley A. Cole, 28, of Castorland, pleaded GUILTY to first-degree Sexual Abuse, a class "D" felony. Sentencing was set for November 4th. Mr. Cole was accused of having inappropriate contact with a male victim under the age of eleven in September of 2014. Andrew M. Ellis, 30, Lowville, pleaded GUILTY to a charge of second-degree Criminal Trespass, a class "A" misdemeanor. Sentencing in the case was adjourned until November 4th. Mr. Ellis was accused of possessing a 2015 Novai dump trailer belonging to another party on September 17, 2015, in the town of West Turin. David Kayne, 44, of Shokan, NY, pleaded GUILTY to charges of fifth-degree Criminal Sale of a Controlled Substance, a class "D" felony and fifth-degree Criminal Possession of a Controlled Substance, a class "D" felony. Sentencing was adjourned until December 2nd. Mr. Kayne was accused of possessing and selling LSD during the moe.down music festival in August, 2014. Jody L. Matthews, 44, Edwards, entered a GUILTY plea to a charge of Aggravated DWI, a class "D" felony. Sentencing was set for October 20th. Mr. Matthews, who has two prior felony DWI convictions in St. Lawrence County, was arrested following a traffic stop of his ATV on Factory Road in the Town of Montague on April 16th during the SNIRT Run, where he had a blood alcohol content of .23%. Daryan J. Nichols, 18, of Lowville, pleaded GUILTY to charges of third- degree Unlawful Manufacture of Methamphetamine, a class "D" felony and first- degree Reckless Endangerment, a class "D" felony. Sentencing in the case was scheduled for November 4th. The charges stem from his alleged involvement in the May 18th fire that destroyed an apartment house in downtown Lowville. Other Activity Brenda Roth, 49, of Deer River, appeared, with defense attorney Gary Miles filing a motion to have the Grand Jury testimony in the case released to the defense prior to the trial, scheduled for December 5th. Judge King heard arguments from the prosecution and defense and will make a ruling in the near future. In July, reinstated charges of second-degree Manslaughter, Criminally Negligent Homicide, Tampering With Evidence and Endangering the Welfare of a Child, were brought against Ms. Roth. In June of 2015, Judge Daniel R. King had dismissed the counts of Manslaughter, Criminally Negligent Homicide and Tampering With Evidence, but an appellate court in Rochester reinstated them in July of this year. The charges against Ms. Roth stem from the December 28, 2014 death of Derek M. Holton, 15, who became unresponsive after allegedly ingesting prescription and over-the-counter medication at Ms. Roth’s residence in Deer River. Gregory S. Ward, 31, of Glenfield, was arraigned on a four-count indictment, including a charge of third-degree Criminal Possession of a Controlled Substance with Intent to Sell, a class "B" felony. He pleaded not guilty to all counts in the indictment and the case was adjourned until October 20th. |
