Port Leyden Man Sentenced to 40 Year
Prison Term on Child Sex Abuse Charges

    Lowville, NY- A Port Leyden man was sentenced in Lewis County Court this
    morning on eight guilty verdicts returned by a jury in September.

    Michael S. Daskiewich, 58, was sentenced to a term of 20 years each in State
    prison on the top two counts of first-degree Criminal Sex Act, class B felonies, to
    be served consecutively for a total term of 40 years in prison.

    Judge Daniel R. King stated that the fact that Mr. Daskiewich has "not owned his
    conduct" or taken accountability for his actions were factors in determining
    sentencing.

    Prior to sentencing, prosecutor Caleb Petzoldt had asked Judge King to consider
    a 25 year sentence, while defense attorney Kevin Dwyer had requested a term of
    15 years in prison, as offered to his client in a plea bargain deal he rejected prior
    to trial.

    Mr. Daskiewich stood trial in September, with a jury returning guilty verdicts on all
    eight counts he was facing:

  • 2 counts of first-degree Criminal Sex Act, class B felonies
  • 1 count of first-degree Sexual Abuse, a class D felony
  • 2 counts of third-degree Criminal Sex Act, class E felonies
  • 2 counts of Unlawfully Dealing With a Child, class A misdemeanors
  • 1 count of Endangering the Welfare of a Child, a class A misdemeanor

    Sentences for the remaining charges will run concurrent to the top two counts.

    Mr. Daskiewich was additionally ordered to pay $1,375 in court fees.
