Lewis County Court Report: July 19, 2019

    Lowville, NY- The following plea and sentencing activity took place Friday
    morning in Lewis County Court, with the Honorable Daniel R. King presiding:

    Timothy J. Carman. 38, of Port Leyden, pleaded guilty to one count each of
    fourth-degree Criminal Possession of Stolen Property, a class E felony, and third-
    degree Aggravated Unlicensed Operation of a Motor Vehicle, an unclassified
    misdemeanor. Mr. Carman admitted to possessing a 2012 Dodge Durango that
    did not belong to him on January 2 in the town of West Turin, while driving the
    vehicle knowing that his license to drive had been suspended for having 16
    traffic tickets on 11 dates. He was then placed on interim conditions of probation
    for a year. If successful the felony count will be reduced to a misdemeanor and
    he will be sentenced to 3 years of probation. If unsuccessful he would likely
    serve 1 year in Lewis County jail. Final sentencing was adjourned to July 17,
    2020.

    Jesse J. Farney, 33, of Glenfield, was placed on interim conditions of probation
    for one year after pleading guilty to one count of fourth-degree Welfare Fraud, a
    class E felony, during an appearance on May 31. He admitted to receiving
    $1,620 in SNAP benefits by providing false information to the Lewis County
    Department of Social Services. Final sentencing was scheduled for July 17, 2020.

    Abigail J. Loomis, 35, of Ava, was placed on interim conditions of probation for
    one year after pleading guilty to one count of fourth-degree Criminal Possession
    of a Controlled Substance, a class C felony, during a May 17 appearance where
    she admitted to possessing hydromorphone in the town of West Turin in July of
    2018. If successful she will be allowed to withdraw her guilty plea to the felony
    charge and instead plead to a misdemeanor charge and serve 3 years of
    probation. If unsuccessful she will face a year in Lewis County jail. Final
    sentencing was adjourned to July 17, 2020.

    Ginger L. Misener, 38, of Glenfield, was sentenced to 5 years on probation
    after pleading guilty to one count of fourth-degree Welfare Fraud, a class E
    felony, on May 31. Ms. Misener admitted to receiving $1,317.80 in public
    assistance benefits to which she was not entitled to. She was ordered to pay
    $375 in court fees and $1,317 in restitution, in addition to being banned from
    receiving any public assistance benefit for one year.

    Larry M Mutchler, 39, of Lowville, was sentenced to time served on a charge of
    Endangering the Welfare of a Child, a class A misdemeanor, to which he pleaded
    guilty to on April 26 after admitting to sending an adult pornographic video to a
    minor on October 4, 2018, in the village of Lowville. He was ordered to pay $250
    in court fees and an order of protection was issued on behalf of the victim for 5
    years. Mr. Mutchler was then placed on interim conditions of probation for one
    year on a charge of fifth-degree Attempted Criminal Possession of a Controlled
    Substance, a class E felony, to which he also pleaded guilty to on April 26 after
    admitting to attempting to possess methamphetamine, with the intent to sell, in
    the village of Lowville on February 4. Final sentencing on that charge was
    scheduled for July 17, 2020.

    Daniel J. Paquette, 39, of Rome, pleaded guilty to one county each of
    Aggravated Driving While Intoxicated With Child in Vehicle (Leandra's Law), a
    class E felony; Driving While Intoxicated, an unclassified misdemeanor; and
    Speeding, a traffic infraction. He admitted to driving while intoxicated in the town
    of Lewis on June 8 with two children under the age of 16 in the vehicle. Mr.
    Paquette was placed on interim conditions of probation for one year. If successful
    the felony charge will be vacated and he will be sentenced to 3 years on
    probation. If unsuccessful the felony will remain and he will be sentenced to one
    year in Lewis County jail. Final sentencing was scheduled for July 17, 2020.

    Mark A. Rahman, 35, of Stamford, NY, was sentenced to serve one year in
    Lewis County jail, to run concurrent to time in State prison on a sentence from
    Deleware County, on a charge of third-degree Identity Theft, a class A
    misdemeanor. He pleaded guilty to the charge on April 26, admitting to opening a
    credit card in the victim's name and then making unauthorized purchases. Mr.
    Rahaman was additionally ordered to pay $250 in court fees and an order of
    protection was issued on behalf of the victim for 5 years,

    German Sapon Yax, 21, was sentenced to serve one year in Lewis County jail
    on a charge of second-degree Assault, a class D violent felony, to which he
    pleaded guilty to on July 12, when he admitted to stabbing another individual in
    the chest, causing injury, on November 20 at Demko Farm in the town of
    Martinsburg. He was additionally ordered to pay $375 in court fees. During the
    July 12 plea allocution, Judge King advised Mr. Yax that he would likely be
    deported after serving his sentence as a result of his conviction.
