in Lewis County Court, with the Honorable Daniel R. King presiding: Patrick M. Booth, 38, was sentenced to serve 3 years in State prison followed by 2 years of post release parole, on a count of third-degree Unlawful Manufacture of Methamphetamine, a class D felony, to which he pleaded guilty to on May 13. He was additionally ordered to pay $375 in court fees and will have his license to drive suspended for 6 months. Mr. Booth was sentenced as a second-felony offender, with previous felony convictions in Jefferson County, NY for Burglary in 2012 and Attempted Criminal Possession of a Controlled substance in 2015. During the plea allocution on May 13, Mr. Booth admitted to possessing materials used in the manufacture of methamphetamine during a vehicle stop in the town of Lowville on July 26, 2018. Darick R. Brand, 30, Glenfield, was arraigned on one count each of third-degree Burglary, a class D felony, and Petit Larceny, a class A misdemeanor. Mr. Brand entered guilty pleas to both counts, admitting to entering the Lowville Walmart on March 14, 2019 with the intent to commit a crime and taking $33.25 worth of merchandise without paying for it. He was previously banned from all property owned by Walmart after a shoplifting at the Lowville store in June of 2018. Mr. Brand was placed on interim conditions of probation for one year. If successfully completed, the felony plea would be vacated and he would face probation on the remaining misdemeanor charge. If unsuccessful, he would be sentenced to serve 2 to 6 years in State prison. Final sentencing was scheduled for July 9, 2020. Herbert E. Lamb, 45, was sentenced to serve 10 years in State prison followed by 20 years of post release parole on charges of first-degree Rape, a class B felony, and third-degree Incest, a class E felony, to which he pleaded guilty to on May 17. He was additionally ordered to pay a total of $2,850 in court fees and fines. An order of protection was issued on behalf of the victim. During his plea allocution in May, Mr. Lamb admitted to engaging in unwanted sexual intercourse with another person by forcible compulsion on September 18, 2018 in the town of Martinsburg and engaging in intercourse with a person known to be related to him on August 17, 2018 in the Town of Martinsburg. Rebekah L. Pettit, 29, of Watertown, pleaded guilty to one count each of fourth- degree Insurance Fraud, a class E felony and second-degree Offering a False Instrument for Filing, a class A misdemeanor. Ms. Pettit admitted to providing false information to the Department of Labor and failing to report income in order to receive $7,003 in unemployment benefits to which she wasn't entitled between October 31, 2016 and April 16, 2019. Sentencing was adjourned to September 20, when she is expected to be placed on interim conditions of probation. David A. Sutton, 27, of Croghan, was sentenced to serve 1 year in Lewis County Jail and ordered to pay $100 in court fees on charges of fifth-degree Criminal Possession of Stolen Property and second-degree Criminal Contempt, both class A misdemeanors. He pleaded guilty to the charges on May 4. German Sapon Yax, 21, appeared with the assistance of a translator on video conference, entering a guilty plea to a charge of second-degree Assault, a class D violent felony. He admitted to stabbing another individual in the chest, causing injury, on November 20 at Demko Farm in the town of Martinsburg. Sentencing was adjourned to July 19, when Mr. Yax is expected to receive a 1 year term in Lewis County Jail. Judge King advised Mr. Yax that he would likely be deported after serving his sentence, as a result of his conviction. |
