Prison After Motion to Vacate Guilty Pleas Denied

    Lowville, NY- A Port Leyden man was sentenced to a term in State prison in
    Lewis County Court on Friday, with the Honorable Daniel R. King presiding.

    Cody J. Fox, 28, of Port Leyden, was sentenced to serve 14 years in State prison
    followed by 5 years of post-release parole after pleading guilty to the following
    counts on March 1:

  • Second-degree Criminal Possession of a Weapon, a class C Felony;
  • Second-degree Unlawful Manufacture of Methamphetamine, a class C
    Felony;
  • Second-degree Assault, a class D felony

    The plea deal satisfied all charges Mr. Fox was facing from arrests on January 9,
    2018 and February 24, 2018. He faced up to 45 years in prison if convicted on all
    counts.

    Before sentencing was imposed, Jeff Tompkins, the attorney representing Mr.
    Fox through the McClusky Law Firm, made a motion to Judge King to have his
    client's guilty pleas from March 1 vacated.

    Mr. Fox told Judge King that he felt rushed into taking the plea deal. The case
    had been scheduled to proceed to trial at the time Mr. Fox accepted the plea
    deal. Judge King ultimately denied the motion, noting that Mr. Fox entered his
    pleas without hesitation during the allocution on March 1, during which time he
    was asked a series of questions to ensure his plea was being entered voluntarily.

    Mr. Fox was additionally ordered to pay $1,125 in court fees.
