| Man Sentenced to Prison Time With Treatment Mandate After Guilty Pleas to Burglary and Bail Jumping May 20, 2019 07:30 p.m. |

with the Honorable Daniel R. King presiding, pleading guilty to one count each of third-degree Burglary and second-degree Bail Jumping. Joshua M. Beardslee, 33, admitted to stealing $481.73 worth of merchandise from the Lowville Walmart store on March 29, 2018, entering the store with the intent to commit a crime. He was previously banned from entering any Walmart store in July and November of 2017. He also admitted to failing to appear in court on at least five occasions after being released on his own recognizance when originally arraigned on the charge. Mr. Beardslee was then sentenced as a second-felony offender to serve 2 1/2 to 5 years in State prison on the Burglary charge, followed by a consecutive term of 1 1/3 to 3 years in State prison on the Bail Jumping charge. Judge King then, with agreement from the District Attorney's office, mandated Mr. Beardslee to the State Prison System's 90-day Willard Drug Rehabilitation program, which allows individuals to serve the remainder of their sentence on parole after successful completion, noting the defendant's history of controlled substance dependency as a contributing factor in his criminal conduct. He was additionally ordered to pay $750 in court fees and $529.90 in restitution including a ten percent surcharge. Mr. Beardslee has a previous felony conviction for third-degree Burglary in Otsego County from 2010. |
