Criminal Court with the Honorable Daniel R. King presiding: Timothy J. Brown, 40, Turin, was sentenced as a second felony offender on a charge of second-degree Forgery, a class "D" felony, to which he pleaded guilty to on August 4th. He was sentenced to serve 3 1/2 to 7 years in State prison and ordered to pay $375 in court fees and $13,826.49 in restitution. Mr. Brown was accused of forging the signature on a bank check and cashing it at the Northern Federal Credit Union in the Town of Lowville on March 3, 2016. He was previously convicted of third-degree Burglary on December 07, 2007. Victor G. Ehlers, 35, of Lyons Falls was arraigned on a charge of third-degree Unlawful Manufacture of Methamphetamine, a class "D" felony, to which he entered a plea of NOT GUILTY. A trial date of February 05, 2018 was tentatively scheduled. Erin Elliott, 37, of Watson, was sentenced to a one-year Conditional Discharge on a charge of fourth-degree Criminal Possession of Marijuana, a class "A" misdemeanor, to which she pleaded guilty to on July 14th satisfying all charges she was facing. She was additionally ordered to pay $250 in court fees and had assets forfeited. Ms. Elliot was accused of having over 20 ounces of marijuana plants at her residence when a search warrant was executed on May 5th. Shaun K. Elliot, 31, of Watson, was sentenced to serve 4 years in State prison followed by two years of parole supervision on charges of second- degree Criminal Possession of Marijuana, a class "D" felony; second-degree Criminal Sale of Marijuana, a class "D" felony; and fourth-degree Criminal Possession of a Weapon, a class "A" misdemeanor, to which he entered guilty pleas on July 14th. He was then mandated by Judge King to the State Prison System’s 90-day Willard Drug Rehabilitation Program, which allows inmates who successfully complete the program to serve the remainder of their prison sentence under parole supervision. A Willard mandate requires a prisoner to have three or less years remaining on their sentence, meaning Mr. Elliot will need to serve a year before becoming eligible for the Willard program. He was additionally ordered to pay $40 in restitution and $425 in court fees, as well as receiving a driver's license suspension for a period of six months. Mr. Elliott was accused of selling four ounces of marijuana to a fifteen-year-old male on January 4th, while also possessing brass knuckles on the same day. He was additionally accused of possessing more than 24 ounces of marijuana plants on May 5th during the execution of a search warrant at his residence. Justin R. Halladay, 32, of Croghan, was sentenced to serve a 3 year probation term on an amended charge of second-degree Criminal Trespass, a class "A" misdemeanor, after successful completion of Interim Conditions of Probation. He was ordered to pay $50 in court fees and an order of protection was issued on behalf of the victim for a period of five years. Mr. Halladay was accused of unlawfully entering a building on Long Pond Road in the Town of Croghan on January 16th, 2016. Kenneth D. Lance, Jr., 28, Adams, was sentenced to serve 9 months in Lewis County Jail on a charge of third-degree Assault, a class "A" misdemeanor, which he entered a guilty plea to on August 4th. He was additionally ordered to pay $250 in court fees and an order of protection was issued on behalf of the victim for a period of 5 years. Mr. Lance was accused of getting into an argument with a male individual and then striking him in the head with a wrench, causing a laceration, on July 16, 2017 in the Town of New Bremen. Shannon M. LaQuay, 45, of Lowville, was sentenced to a one-year Conditional Discharge and 50 hours of community service on a charge of Disorderly Conduct, a violation, to which she pleaded guilty to on September 29th. She was additionally ordered to pay $115 in court fees and was prohibited from applying for public assistance for one year. Ryan M. O'Connel, 33, was arraigned and entered a GUILTY plea to felony DWI. Sentencing was scheduled for December 15th. Mr. O'Connell was accused of operating a motor vehicle under the influence of alcohol in the Town of Greig on Brantingham Road on February 18th. He was previously convicted of DWI on July 09, 2009 in the Town of Martinsburg, resulting in the felony charge for the current incident. Jason Ward, 40, Lowville, was sentenced to serve a five-year probation term on an amended charge of fifth-degree Criminal Sale of a Controlled Substance, a class "D" felony, to which he pleaded guilty to on August 5th, satisfying all charges in a four count Grand Jury indictment. He was additionally ordered to pay $375 in court fees and had his driver's license suspended for a period of six months. Mr. Ward was accused of selling morphine in the Village of Lowville on two occasions in January. |
