Friday morning, with the Honorable Daniel R. King presiding, each entering guilty pleas in their respective cases. Joseph R. Fitzgerald, 25, was arraigned on a charge of third-degree Criminal Possession of a Controlled Substance- With Intent to Sell, a class "B" felony, to which he entered a plea of GUILTY. Sentencing was set for September 8th. Mr. Fitzgerald was accused of possessing morphine with the intent to sell when a search warrant was executed at his residence on February 9th. Nicole A. Stauring, 25, who resides with Mr. Fitzgerald, was arraigned on a charge of fifth-degree Criminal Possession of a Controlled Substance, a class "D" felony. She pleaded GUILTY to the charge, with sentencing adjourned until September 8th. Ms. Stauring was accused of possessing cocaine when the residence was searched on February 9th. Justin J. Hurley, 32, was arraigned on charges of second-degree Unlawful Manufacture of Methamphetamine, a class "C" felony; second-degree Burglary, a class "C" felony; fourth-degree Criminal Possession of Stolen Property, a class "E" felony; third-degree Identity Theft, a class "A" misdemeanor and second-degree Criminal Possession of a Forged Instrument, a class "D" felony. He entered GUILTY pleas to the first four counts, and was allowed to enter an Alford plea on the Criminal Possession of a Forged Instrument charge, meaning he did not admit to the underlying allegations of the charge but was pleading guilty to avoid the possibility of a harsher sentence if convicted at trial. Sentencing in the case was set for September 22nd. Mr. Hurley was accused of breaking into a Village of Lowville home on December 24th, stealing a credit card and checkbook which he later used. The meth charge stems from a February 18th incident in the Village of Lowville. Jamie L. Kloster, 33, pleaded guilty to third-degree Unlawful Manufacture of Methamphetamine and was then placed on one-year of Interim Conditions of Probation. She was accused of making methamphetamine at a residence in the Town of Greig on December 3rd. In other plea activity taking place Friday morning in Lewis County Court, Corey D. Marolf, 21, of Turin, was arraigned on a charge of fourth-degree Criminal Possession of a Weapon, a class "A" misdemeanor, to which he entered a plea of GUILTY. Sentencing was scheduled for September 8th. During a traffic stop in the Town of Croghan on March 23rd, Mr. Marolf was accused of possessing an AR15 Rifle with thirty-round ammunition clips, which are illegal to possess in New York State. |
