Lewis County Court, to a charge of third-degree Criminal Sale of Marijuana- a class "E" felony. Mr. Hoffert was then placed on one-year of interim terms of probation by Judge Daniel R. King. If successful, the felony plea would be vacated and replaced with a fourth-degree Criminal Sale of Marijuana, which is a class "A" misdemeanor. Sentencing will take place at the conclusion of the interim probation period. Mr. Hoffert was accused of selling 37.8 grams of marijuana to a subject at the Lock 96 store in Port Leyden on July 5, 2016. He was arrested on January 10 along with four others, after sealed indictments were handed down by a Lewis County Grand Jury as part of the ongoing Operation Northern Watch investigation into possession and sales of controlled substances. |
