Lewis County Court Activity Report: Friday, March 03, 2017

    Lowville, NY- The following activity took place in Lewis County Criminal Court
    on Friday, March 03, 2017, with Judge Daniel R. King presiding:

    Sentencing:

    Jessie J. Bourgeois, 35, Port Leyden was sentenced to time served and a
    three-year probation term on an amended charge of third-degree Attempted
    Criminal Mischief, a class "A" misdemeanor, and a charge of second-degree
    Menacing, a class "A" misdemeanor, to which he pleaded guilty to on February
    17th. An order of protection was issued on the victim's behalf, for a period of
    five years. Mr. Bourgeois was accused of damaging items belonging to his
    mother and wielding an ax during a dispute in November of 2015.

    Kenneth J. Juby, 21, Glenfield, was sentenced to serve six months in Lewis
    County Jail and a ten year probation term on a charge of third-degree Rape, to
    which he pleaded guilty on January, 20, 2017. He was additionally ordered to
    pay $1,425 in court fees and must register as a Level 2 Sex Offender. An order
    of protection was issued on behalf of the victim for an eight-year period. Mr.
    Juby was accused of having sexual intercourse with a girl under the age of 17
    on September 01, 2016, in the Village of Lowville.

    David Kayne, 44, of Shokan, NY, was sentenced to serve six-months in the
    Lewis County Jail followed by a five-year probation term on charges of fifth-
    degree Criminal Sale of a Controlled Substance, a class "D" felony and fifth-
    degree Criminal Possession of a Controlled Substance, a class "D" felony, to
    which he pleaded guilty on September 23, 2016. He was additionally ordered
    to pay $50 in court fees and will have his drivers license suspended for six
    months. Mr. Kayne was accused of possessing and selling LSD during the moe.

    Luke M. Racine, 30, Glenfield, was sentenced to serve five years in State
    Prison, followed by five year term of post release parole, on a charge of
    second-degree Criminal Possession of a Weapon, to which he pleaded guilty
    on January 20, 2017. He was additionally ordered to pay $375 in court fees.  

    Cayla M. Wujek, 24, of Brantingham, was sentenced to serve six months in
    Lewis County Jail and a five year probation term on a charge of Aggravated
    Cruelty to Animals, a class "E" felony, to which she pleaded guilty on July 29,
    2016. She was also ordered to pay $325 in court fees. Ms. Wujek was arrested
    after allegedly putting a cat belonging to someone else into a pillow case and
    striking it against a rock several times, and then stabbing the cat, according to
    court documents. The incident took place in February of 2016 in the Town of
    West Turin.

    PLEAS:

    Aaron J Croniser, 22, of Ava, entered a GUILTY plea to the charge of third-
    degree Burglary, a class "D" felony. Sentencing in the case was adjourned to
    May 12th. The charge stems from an incident at the Walmart store in the Town
    of Lowville, occurring on June 22, 2016. Mr. Croniser, currently in Oneida
    County Jail, is also facing Robbery charges in Oneida County.

    John C. Kalitzke, 49, Brantingham, pleaded GUILTY to Aggravated Driving
    While Intoxicated, a class "E" felony. He was then placed on Interim Terms of
    Probation for one year, with sentencing scheduled for March 02, 2018. He was
    accused of driving with a .19% BAC in the Town of Greig on October 29, 2016.
    Mr. Kalitzke was previously convicted of DWI in the Town of Greig on
    September 11, 2012.

    Jonathan E. McClusky, 33, Watertown, entered a GUILTY pleas to charges
    of second-degree Criminal Trespass and fourth-degree Criminal Mischief, both
    class "A" misdemeanors. Sentencing was set for June 02, 2017. He was
    accused of damaging a door and entering a residence in the Town of Denmark
    on January 08, 2017.

    Cory W. Peck, 35, Carthage, entered a GUILTY plea to a charge of Driving
    While Intoxicated, a class "E" felony due to a previous conviction. He was then
    placed on Interim Terms of Probation for one year, with sentencing scheduled
    for March 02, 2018. Mr. Peck was accused of operating a motor vehicle while
    intoxicated on September 30, 2016 on the Stillwater Road. He was previously
    convicted of DWI on February 05, 2009, in the Town of Wilna.
